Guilty On All Counts

This week a Manhattan, New York jury found former-president Donald Trump guilty of 34 counts of falsifying business records in an effort to influence the 2016 election. Trump did not want it known that back in 2008 he was involved an extra-marital relationship with a porn star.

Star witness Michael Cohen testified that Trump schemed with David Pecker. the publisher of The National Enquirer, to “catch and kill” this spicey story. Trump has denied his affair with Stormy Daniels and pleaded not guilty to misrepresenting his intentions. Documents revealing financial transfers amounting to the $130,000 in ten separate checks and signed by Trump, were entered as evidence as to the “cover up” evidence and factored in the jury decision.

Trump is scheduled to be sentenced on July 11th. Whatever Judge Juan Merchan’s decision may be, it will probably be appealed, leaving Trump free to appear at 2024 at the Republican National Convention beginning on Jul 15, 2024 and the 2024 United States presidential debates on June 27 hosted by CNN and the second on Sept. 10 on  ABC. And the ex-president may be wearing an “ankle bracelet” while attempting to vote in the General Election held on November 5, 2024.

Ex-president Trump has called the jury’s decision a “disgrace” saying that the “real verdict” will come during the presidential election on November 5. President Joe Biden replied on social media that his 2024 rival can only be defeated at the ballot box. Even so, it’s not clear as to how matters would work if Trump won the Presidential election while serving house arrest or prison time. Our founding fathers could have never foreseen such a radically incongruous situation.

Along with the exceptionally dangerous challenges that ex-president Donald Trump continually presents to our nation and to the watching world, we can take solace in the fact that our legal system continues to work. A jury of twelve American citizens carefully considered both sides of this case, consisting of the prosecution and the defense. Together the jury carefully came to a verdict, and the sentence, which will be enforced in days to come, is being decided now.

As it is explained on Lexisnexus, ‘the American judicial system is a “common law” system, which relies on court precedent. In our common law system, even when a statute is at issue, judicial determinations in earlier court cases are extremely critical to the court’s resolution of the matter before it.” While Trump has been determined guilty, one of the difficulties regarding his sentence that there no precedents for a presidential candidate who happens also to be a convicted felon.

Prosecution on the left
and defense on the right.

Another feature of American Law is that in court, there are two sides: the prosecution and the defense. In this case the prosecution, represented by the state of New York, is responsible for proving the defendant’s guilt beyond a reasonable doubt. The defense represents the defendant, challenging the prosecution’s evidence and arguments. “The judge in a criminal case tells the jury what the law is. The jury must determine what the true facts are. On that basis, the jury has only to determine whether the defendant is guilty or not guilty of each offense charged.”

The principle members of The People of the State of New York v. Donald J. Trump Prosecution team are: Alvin Bragg, Manhattan’s District Attorney; Joshua Steinglass, Prosecutor: Mathew Colangelo, Senior Counsel; Christopher Conroy, Executive Assistant District Attorney and Chief of the Investigation Division and Susan Hoffinger, Prosecutor and  Executive Assistant District Attorney and Chief of the Investigation Division for the Manhattan DA’s office. Donald Trump’s defense team consists of Todd Blanche, Susan Necheles, and Emil Bove. The judge presiding over this historic trial is the Honorable Juan Marchan.
